Deliverable: Advisory + Severance and Release Agreement Hello, we have an employee we need to terminate and want to ensure: 1. We get council and take correct action to mitigate companies liability/exposure 2. Give results of internal investigation for you to use as leverage in a severance & release letter 3. Ensure language has non-competes, reinforce the non-competes and NDA he has already signed. Quick facts: *Employee/contractor was 1099, then w2, now currently 1099 again, he does receive salary and has company laptop and equipment + car (all will need to be turned in). *He is also paid commission (not commission only) *He has been caught stealing money (serving clients on his own and collecting money to profit) warning was given *Employee has recently been caught doing the same thing again in a more strategic manner. Goal is to walk away and get all property back and ensure he does not go work directly for competition and also he does not take clients on his own as well as compete and or sue us for anything else
