Job Description:
I am looking for a lawyer to draft an agreement between me and my husband. Under this agreement, I would represent my husband in jointly investing in a property with another investor, with my husband being the beneficial owner of his share of the investment while I would only be a nominee shareholder. My husband's name would therefore not even appear in the land register.
Background to the problem:
My boss, who is the managing director of a small company, offered that he and my husband and I could invest in rental properties together, with him owning 50% and my husband and I owning the other 50%. This is an attractive offer for us as he has a lot of experience in investing and we could learn something from him. However, he requires me to enter into a trust deed with him to facilitate the mortgage arrangement for just me (for both my husband and I, as my husband is not a UK citizen). However, my husband is the person who will put his savings into this investment in return for our share. He should therefore be assured that the share belongs to him, even though I would be listed as a co-owner in the land registry.
My boss has already drawn up a trust deed under which the ownership will be of the tenancy in common type, where 50% of the share belongs to him and 50% to me.
Interview questions:
Is it even legally possible in the UK for my husband to remain hidden as beneficial owner of 50%? Are there any risks associated with doing this? In the event that I get into debt in the future, can my husband be sure that the enforcement officer cannot take his share of the property believing that it belongs to me?
Will such an agreement be sufficient to prove who is the beneficial owner, if necessary in the future?
