Job Description:
I have recently been put at risk with 36 colleagues. The firm plans to move 12 roles from the UK to South Africa. As this is an intercompany transfer we are advised that TUPE would apply. We have been advised it would be unreasonable to expect anyone to actually transfer so a redundancy process will also commence. Because of TUPE ETO rules we have also been advised that anyone willing to transfer would have their T&C’s changed to local T&C’s resulting in a drop of salary and benefits. The ETO reason is cost saving and efficiency, the is no technical reason and organisational they are changing the structure slightly. We are currently going through the consultation process. Our HR team are on the side of the business and offering very little support and guidance, although we are allowed to seek legal advice, we can’t be directly represented at this stage although due to the way they are running the process it could possibly lead to unfair dismissal but we need some advice.
