Aim: To demonstrate knowledge of the importance of negligence and its impact on construction.

Task: Discuss negligence and the remedies which are available to claimants in the Building and Construction Indsutry, with particular relevance to the following case:

Archie is an architect and is a member of a congregation of a local church. About six years ago he gave free advice to the trustees of that church about the design of a new sports hall to be built on some vacant land owned by the church. He recommended the use of the proudct 'plastigirder' to span and support the main roof. This variet of girder was made from cheap but very strong plastic.

If Archie had read a circular from the Building Research Establishment, he would have realised that defects had been discovered in this type of girder and that they are unsuitable for use in projects such as sport centres, assembly halls and similar structures.

Six months ago the trustes of the church sold the hall to the local authority. The main roof has collapsed due to inadequacy of the girders.

No one was in the building at the time but some valuable equipment belong to the local authority had been destroyed.

Discuss the approaches that the courts may adopt to deal with the above case. Your answer must include an analysis of previous cases and principles.

Demonstrate knowledge on elements of duty of care and breach of duty giving rise to negligence including the functions of tort law (10 marks)

Case scenario - discuss the approaches that the courts may adopt to deal with the case (60 marks)

Demonstrate knowledge of previous cases and the principles which were applied to reach decisions (10 marks)
