The facts are that the plaintiff company sold paint for a price of $260 thousand. The defendant company has not paid. The statement of claim indicates that the deed provided that the defendants agreed to pay the plaintiff any amounts which might become due and owing by the said defendant company. The affidavit of the defendant indicates that the defendant recalls signing a number of documents and the plaintiff's solicitor indicated to him that one of them was a guarantee. He states that he was induced to sign the guarantee on the misrepresentation of the plaintiff's solicitor that the liability under the guarantee would only last for three months from the date of signing. The second part of the affidavit deals with the purchase of additional paint and equipment from the plaintiff to supply to other housepainters (indicating the paint was defective/not fit for purpose) and indicating that the costs of claims aginst the defendant will exceed the amount being claimed by the plaintiff from the defendant.
